1. The above Original Application has been filed by the Applicant under the provisions of Section 14 of the Armed Forces Tribunal Act, 2007, praying for directing the Respondents for grant Service Pension for the rank of Honorary Naib Risaldar wef 01.04.2014 in terms of PCDA (P) Circular No 631 and further revision wef 01.07.2014 in terms of PCDA (P) Circular No 555, wef 01.01.2016 in terms of PCDA (P) Circular No 570, wef 01.07.2019 in terms of PCDA (P) Circular No 666, and wef 01.07.2024 in terms of PCDA (P) Circular No 677 and that the arrears be paid along with interest @ 12% per annum.

2. Brief facts of the case are that the Applicant was enrolled in the Army on 09.03.1988 and after rendering more than 26 years of service, he was discharged from Service on 31.03.2014 in the rank of Havildar and was granted Service Pension for the rank of Havildar. After retirement, the Applicant was conferred with the Honorary rank of Naib Risaldar on 15.08.2014 and Part II Order dt 20.08.2014 was published to that effect. However, the Applicant has not been granted Service Pension for the rank of Honorary Naib Risaldar. The Applicant submits that he is entitled for Service Pension to the rank of Honorary Naib Risaldar wef 01.04.2014 to 30.06.2014 in terms of PCDA (P) Circular No 631 dt 05.03.2020 and, thereafter, further revision in terms of OROP-1 wef 01.07.2014, 7th CPC wef 01.01.2016, OROP-2 wef 01.07.2019 and OROP-3 wef 01.07.2024 in terms of PCDA (P) Circular Nos 555, 570, 666 and 677 respectively. The Applicant made several representations and also issued Legal Notice for grant of Service Pension for the rank of Honorary Naib Risaldar, but to no avail. Therefore, the aggrieved Applicant has filed present OA.

3. The Respondents (R1-3) have filed a detailed reply and while not disputing the basic facts presented by the Applicant, they have submitted that the Applicant is entitled for Service Pension for the rank of Honorary Naib Risaldar, as claimed by the Applicant. However, due to an oversight, the claim for notification of Corrigendum PPO for the rank of Honorary Naib Risaldar to the Applicant could not be processed to PCDA (P). On coming to the notice of Respondents, the case for notification of Corrigendum PPO showing the rank as Honorary Naib Risaldar along with entitled pension has been taken up with PCDA (P) vide data sheet dt 20.12.2024 and the PCDA (P) has again been approached online on 20.12.2024 for uploading the Corrigendum PPO, however, the ibid PPO is yet to be notified. The arrears of payment of pension in the rank of Honorary Naib Risaldar, as per his entitlements, shall be credited into the account of the Applicant by PCDA (P) through Sparsh after notification of his PPO.

4. We have heard Learned Counsels for both the parties and perused the material placed before us.

5. It is not in dispute that the Applicant is entitled for grant of Service Pension for the rank of Naib Risaldar. The case has been processed to PCDA (P) for notification of Corrigendum PPO for the rank of Honorary Naib Risaldar and the arrears shall be credited into the Applicant’s account as per his entitlements.

6. In view of the aforesaid facts, we direct the Respondents to issue Corrigendum PPO for the rank of Honorary Naib Risaldar and pay the arrears to the Applicant, if not already paid. The arrears, if any, shall be paid to the Applicant within a period of four months from the date of receipt of a certified copy of this Order, failing which, the arrears shall carry interest at 6% per annum till the date of actual payment.

7. The OA is disposed off accordingly. Pending Miscellaneous Application(s), if any, also stand disposed off.

8. No order on costs.
