ORDER
Date : 19.03.2026 Heard Mr. M. Khan, learned counsel appearing for the petitioner. Also heard Ms. S.H. Bora, learned Addl. P.P. for the State of Assam.
2. The learned Addl. P.P. has assisted in perusing the CD.
3. The learned Addl. P.P has objected to the grant of bail on the ground that several witnesses in the matter have named the petitioner to be involved in the fiasco.
4. This is an application under Section 483 of the BNSS, 2023 for granting bail to the petitioner namely Abul Hussain @ Afsar Ali, who is shown arrested on 20.02.2026 in connection with Bongaigoan P.S. Case No. 14/2026 registered under Section 140 (2)/ 310 (2)/ 119 (2) / 351 (2)/ 121(2) 324 (5)/ 61 (2) BNS, 2023.
5. The petitioner has been in custody since the last 50 days and it is seen that the FIR does not implicate the petitioner, although other persons who had allegedly assaulted the police team have been identified and named in the FIR.
6. The investigation has proceeded to an extent where, in the opinion of this Court, the petitioner who was allegedly called by the police to identify the persons who assaulted police can be granted the privilege of bail.
7. Accordingly, it is provided that the petitioner shall be released on bail on furnishing a bond of Rs. 25,000/- with two sureties of the like amount to the satisfaction of the Learned CJM Bongaigaon.
8. The learned CJM Bongaigaon shall be at liberty to impose such other/additional conditions as may be deemed necessary upon the petitioner to ensure his participation in the trial.
9. It is directed that any attempt of the petitioner to either influence the investigation or to hamper or temper with the evidence would lead to cancellation of bail.
10. This bail application stands disposed of. JUDGE Comparing Assistant
