1. Under Section 14 of the Armed Forces Tribunal Act 2007, the Applicant has prayed for directing the Respondent to consider him for compassionate appointment under the Welfare Schemes by State Government under Department of Sainik Welfare, Government of Rajasthan.

2. The brief facts of the case are that the Applicant’s father, Late Sep Om Beer Singh was enrolled in the Army on 31.12.1965. He sustained Shell Wound Injury on 13.09.1967 in border skirmishes with China at Nathula. The injury sustained by his father was classified as Battle Casualty. The Applicant’s father was placed in low medical category and, consequently, he was invalided out of service on medical grounds and granted War Injury Pension for life. The Applicant, being the son of his disabled father, is entitled for Compassionate Appointment under the provisions of Government of Rajasthan Circular dt

OA No 121/2024 Shri Prahlad Singh Vs UOI & Ors 13.04.2010. The Applicant applied for his compassionate appointment in terms of aforesaid letter dt 13.04.2010, however, the same was rejected on the grounds that the provisions of Government of Rajasthan letter dt 13.04.2020 are applicable for those personnel who are disabled/died on or after 01.04.1999. Therefore, the aggrieved Applicant has filed present OA.

3. The Respondents have filed a detailed Reply Statement and have raised preliminary objections on the grounds that this Tribunal lacks jurisdiction in the matter under Section 3(o) of the Armed Forces Tribunal Act, 2007 and compassionate appointment of the Applicant with the Government of Rajasthan as dependent son of an Ex-Serviceman does not fall in the definition of service matters.

4. On knowing the aforesaid position, Learned Counsel for the Applicant prays for withdrawal of the OA with liberty to make a fresh representation to the State Government of Rajasthan for consideration of his compassionate appointment. In view of the above, we direct that if the Applicant makes a fresh representation before the Competent Authority in the State Government of Rajasthan for his compassionate appointment within a period of one month from the date of receipt of a certified copy of this Order, such Competent Authority shall consider the case of the Applicant sympathetically in terms of Government of Rajasthan letters dt 01.10.2002, 10.06.2008, 13.04.2010 and other relevant rules/ policies within a period of six months thereafter and outcome thereof shall be intimated to the Applicant.

5. The OA is disposed off accordingly. Miscellaneous Application(s) pending, if any, also stand disposed off.

6. No order on costs.
