1. We have heard the counsels for the parties and perused the material placed on record.
2. Perusal of record reveals that despite Notice having been served upon the Respondents PDA 3 & 5 issued in pursuance of Order of this Tribunal dated

27/8/2025, none appears on their behalf, today. The applicant herein has filed this OA praying for directing the Non applicants to refund the impugned recovery effected to the tune of Rs 105,081/- (Rupees One Lac Five Thousand and Eight One only) with the consequential relief. He has also prayed for directing the Non Applicants to pay interest @6% pa on the amount of Rs 105,081/- till the date of actual payment/refund alongwith payment of costs of this application.

The Respdondents No 1,2 & 4 has filed their Reply Statement and submitted that the office of Joint (CDA) Air Force has not proposed any recovery and so far as recovery on account of overpayment of pension is concerned, the matter pertains toPDA/CPPC, ie, the Respondent No 3 and, hence, prayed for discharging/dispensing the Respondents No 1,2 & 4 from the memo of parties in this matter.

The recovery of Rs 8700/- on account of purported excess pension paid to the applicant to the tune of Rs 105,181/- has initiated with effect from 2017 based on the letter dated 31/5/2017 of the State Bank of India, CPPC, Chandni Chowk, Delhi, addressed to the AGM/BM, State Bank of India, Indian Air Force Branch, Jodhpur. In view of this fact, it is ordered that no further recovery shall be effected from the pension account of the applicant without prior notice and/or seeking response from the Applicant after issuing a Notice by the PDA.
5. The OA is disposed off accordingly. No order on costs.
