ORDER

30.09.2026

Heard Mr. M. Biswas, learned counsel for the petitioner. Also heard the learned Addl. Public Prosecutor.

This is an application under Section 528 of the BNSS, 2023 praying for quashing of impugned Order dated 03.09.2026 passed by learned Special Court, ND&PS Act, Aizawl Judicial District, Aizawl in Bail Application No. 429/2026 in connection with Saitual Case No. 55/2026 under Section 21(c) of ND&PS Act, 1985 insofar as it related to the conditions of bail bond and sureties. The petitioner is aggrieved by the bail condition imposed by the learned Trial Court while granting bail to the petitioner by its Order dated 03.09.2026. Amongst others, one of the conditions is that the petitioner shall execute a bail bond of Rs. 3,00,000/- with two (2) sureties of like amount to the satisfaction of the learned Trial Court. The learned counsel for the petitioner submits that the petitioner herein is a divorcee lady with three children and it is extremely difficult for her to arrange sureties who can furnish her bail bonds to the tune of Rs. 3,00,000/- and accordingly prays for reduction of the amount of bail bond. Although bail was granted on 03.09.2026, the petitioner has not been able to come out of jail nearly for a month because of the aforesaid onerous condition. Having regard to the aforesaid facts and since prosecution also does not object to the prayer for reduction, I deem it fit to reduce the amount of bail bond to Rs. 1,00,000/- with two (2) sureties of like amount to the satisfaction of the learned Trial Court in connection with the aforesaid case.

The impugned order stands modified as above. The petition stands disposed of accordingly.
