12.10.2026 Heard Mr. Osbert Khaling, learned counsel appearing for the Applicant assisted by Ms. Sisha Jamir, learned counsel. Also heard Mr. E. Thiba

Phom, learned Public Prosecutor appearing for the Respondent State.

2. Mr. Osbert Khaling, learned counsel for the Applicant prays for withdrawal of the instant application on the ground that in his application before the learned Trial Court below, in I.A. No. 160/2026, he has not divulged the fact with regard to the pendency of the other criminal proceedings against the Accused/Applicant’s husband.

3. It is a well settled position of law that while filing application for bail, it is the abundant duty of the parties to divulge the criminal antecedent before the Court, both in the petition as well as in successful bail applications as held by the hon’ble Apex Court in the case of Zeba Khan vs. State of U.P. reported in 2026 SCC Online SC 188.

4. In the present case at hand, this Court had called for the original Records of the Special Case No. 04/2026 pending before the Special Judge, NDPS, Kohima, Nagaland and on scrutiny of the Records, more particularly the I.A. No. 160/2026, i.e. the Bail Application, it reveals that the applicant have not revealed the pendency of the other criminal proceedings pending against the Applicant’s husband/Accused.

5. The learned counsel for the Applicant prays that liberty may be granted to the Applicant to approach the learned Trial Court below for proper adjudication of the Bail Application by bringing on record the pendency of the other criminal proceedings pending before different Courts.

6. The prayer is allowed.

7. With the above observations, the instant application is dismissed on withdrawal. JUDGE Comparing Assistant
