ORDER
Date : 30.09.2026
1. Heard learned counsel, Mr. C.T. Jamir, assisted by Ms. Krovi Tsukru. Also heard learned Government Advocate, Ms. S. Chang.
2. By filing the instant application under Article 226 of the Constitution of India, the Petitioner has prayed for a direction to the Respondents to consider and dispose of the representation dated 05.09.2025 submitted by the Petitioner.
3. The case of the Petitioner herein is that he was initially appointed as Post Graduate Teacher at the Government Higher Secondary School, Mon on contract basis for a period of 6 [six] months by order No. EDS/HSS/14- 7/2012-1 dated 31.07.2015. The Petitioner’s service was extended from time to time and finally was extended for a period up to 04.09.2016, vide ex post facto order No. DSE/HSS/14-1/2013 dated 15.09.2016.
4. After serving on contract basis from 31.07.2015 to 31.08.2017, the service of the Petitioner was terminated w.e.f. 01.09.2017 vide order No. EDS/HSS/14-1/2013 dated 31.08.2017.
5. Subsequent to the termination of his service, the Petitioner submitted an application for reappointment, which was forwarded to the Principal Director, Department of School Education, Nagaland, Kohima by the Principal of the Government Higher Secondary School, Mon, Nagaland by letter dated 04.09.2017.
6. Subsequently, the Petitioner was again reappointed in service vide order No. EDS/HSS/14-24/16/1636 dated 13.12.2017 and upon submission of applications by the Petitioner, the service of the Petitioner was extended from time to time. While the Petitioner was serving as Post Graduate Teacher (Maths) at Government Higher Secondary School, Mon, the Petitioner was also assigned additional charge as Post Graduate Teacher at the new Government Higher Secondary School, Noklak vide order dated 24.05.2024, whereby he was assigned to serve in 2 [two] schools and he was working as such till the date of his termination by order No. DSE/HSS/14-2/2017(Vol-I)/32 dated 29.08.2025.
7. Subsequent to the termination of his service, the Petitioner submitted applications for reappointment which were forwarded to the Principal Director, School Education, Nagaland, Kohima by the Vice Principal and Chairman SMDC, Government Higher Secondary School, Noklak, Nagaland stating that the Petitioner was the lone Mathematics Post Graduate Teacher and his termination had affected the normal classes of the science stream. This application was forwarded to the Principal Director by the letter dated 03.09.2025.
8. The Petitioner thereafter submitted representation dated 05.09.2025 before the Respondent Authorities requesting reappointment, as he had been serving for more than 10 [ten] years, and also taking into account the fact that the Petitioner was the lone Mathematics teacher and was also holding additional assignments for 2 [two] different schools. However, in spite of the various representations made by the Petitioner and specifically the representation dated 05.09.2025, the Respondent
Authorities have not disposed of the representation till date.
9. The Petitioner has more pertinently pointed out in the writ petition that a similarly situated person namely, Shri Imodangba, Post Graduate Teacher, Wokha Government Higher Secondary School was also terminated along with the Petitioner by the same order on the same date, i.e., 29.08.2025. However, the said Shri Imodangba, who was terminated along with the Petitioner has been granted extension vide order No. DSE/HSS/14-24/16 dated 07.08.2026, but the Petitioner’s case has not been considered, which is discriminatory and violative of Articles 14 and 16 of the Constitution of India.
10. Learned Senior Counsel, at this stage, prays that this petition may be disposed of with a direction to the Respondent Authorities to consider and dispose of his representation dated 05.09.2025 (Annexure-H).
11. The writ petition is accordingly disposed of at the Motion stage and the Respondent Authorities specifically the Respondent Nos. 2, 3 and 4, are directed to consider and dispose of the representation of the Petitioner dated 05.09.2025 by passing a speaking order within a period of 2 [two] months from the date of receipt of this order.
12. With the above direction, the instant writ petition stands disposed of.
