ORDER

Date : 23-09-2026 (D.Baruah,J)

1. Heard Mr. James Newmai, the learned counsel appearing on behalf of the Applicant and Mr. K. Angami, the learned Public Prosecutor appearing on behalf of the State Respondent.

2. This is an application under section 430 of the BNSS, 2023 praying for suspension of sentence pending the appeal and release the applicant/accused on bail.

3. Taking into account the impugned Judgment and Order dated 02.03.2026 we are not inclined to suspend the sentence imposed upon the Applicant/Appellant for the time being. We are also not inclined to accede to the prayer for bail at this stage, for which the instant application stands rejected.

4. We, however, grant liberty to the Applicant that at the time of fixing the Appeal for hearing, he may file a fresh application for bail, if so advised.
