25.07.2025

1. Under Section 14 of the Armed Forces Tribunal Act the applicant has filed this OA praying for directing the Respondents to provide the applicant the copy of the following documents pertaining to her husband to enable her to produce them before the respective Courts of Law in support of her pending cases in the interest of justice :- (a) Pay slip for the month of Apr 2024, May 2024 and the FSA.

(b) Discharge Order under which the applicant’s husband had been discharged from service.

(c) Descriptive Roll

(d) PPO issued to the husband of the applicant.

(e) Date of discharge and cause of discharge.

2. When the matter was taken up at the time of admission, Counsel for the Respondents have raised objection with regard to maintainability of the OA as the applicant is not subject to Army, Navy and Air Force Act.

2

3. Documents pertaining to Ex Hav Parbat Singh’s service have been sought by the Applicant in the OA from the Respondents. It is not in dispute that the request of the applicant to the Respondents made under RTI Act 2005, for supply of service document in respect of her husband, Annexure A/5, was declined by the Respondents. The impugned order was not found under the ambit of Army, Navy and Air Force Act. In view of this, this OA is not entertainable by this Tribunal.

4. Counsel for the applicant prays to withdraw the OA to avail appropriate remedy available to the applicant under the Law.

5. The OA is, therefore, dismissed as withdrawn with liberty to seek appropriate remedy at the appropriate forum.

6. File be consigned to record.
