ORAL ORDER
1. The application is filed by the applicant to condone the delay of 445 days occurred in filing of the Criminal Miscellaneous Application for restoration.
2. Mr. Kalpesh Patel, learned counsel appearing on behalf of Mr. P S Datta, learned counsel for the respondent – accused has vehemently opposed the application and submitted that the delay has not been properly explained in the application.
3. Considering the submissions canvassed by the learned counsel for the respective parties and the averments made in the application, this Court finds that sufficient cause is made out to condone the delay.
