ORAL ORDER

1. This petition is filed by the petitioner seeking parole leave so as to enable the applicant to get the papers of his house at Ahmedabad and farming land at Rajasthan.

2. Earlier, this Court had rejected the application vide order dated 02.07.2026, observing that no documentary evidence was produced by the applicant to show the properties for which the petitioner wants to take conveyance regarding the legal heirs on the record. Considering the documents placed on record, it transpires that the said property initially belonged to the mother of the applicant, who had expired on 06.01.2026, along with documents to the effect that there was a relinquishment deed with respect to the property that belonged to the family of the applicant.

3. Rule. Learned Additional Public Prosecutor waives service on behalf of the respondent – State.

R/SCR.A/14736/2026 ORDER DATED: 12/10/2026 (GJHC240761092026)

5. Having heard and considering the averments made in the petition, more particularly, the ground mentioned therein as well as the jail remarks, this Court is inclined to exercise discretion in favour of the present petitioner.

6. The petition, therefore, succeeds and is partly allowed. The petitioner is ordered to be released on parole for a period of seven days from the date of his/her actual release on his furnishing a personal bond of Rs.10,000/- (Rupees Ten Thousand) to the satisfaction of the concerned jail authority on usual terms and conditions, with a direction that the petitioner shall surrender to the jail authority on expiry of the parole leave period forthwith, with a further condition that the applicant shall mark presence before the nearest police station every 3 rd and 5 th day of the parole leave period. Rule is made absolute accordingly.
