1. Rule. Learned APP waives service of rule for the respondent-State.

2. By way of the present application, the applicant seeks modification of Condition No. (d) imposed by this Hon'ble Court vide order dated 19.08.2015 passed in Criminal Misc. Application No. 13442 of 2015, whereby, the applicant was directed to not leave State of Gujarat as well as India without prior permission of the concerned Sessions Court.

3. Heard learned advocate Mr. Rishi Barot for learned advocate Mr. Subhash Barot for the applicant for the applicant and learned Additional Public Prosecutor Ms. C.M. Shah for the respondent – State.

4. Learned advocate Mr. Rishi Barot for learned advocate Mr. Subhash Barot for the applicant submits that an FIR came to be registered against the applicant for the offences punishable under Sections 406, 409, 120B and 34 of the Indian Penal Code, 1860, at Kheroj Police Station, District Sabarkantha being I-C.R. No.40 of 2014 on 15.11.2014. The applicant thereafter preferred Criminal Misc. Application (For Regular Bail) No.13442 of 2015 before this Court and, vide order dated 19.08.2015, came to be enlarged on bail subject to certain terms and conditions, wherein, Condition No.(d) was imposed directing the applicant not to leave the State of Gujarat as well as India without prior permission of the concerned Sessions Court. Learned advocate submits that, as the applicant is serving on a clerical post in the Education Department and is required to travel to different places across India in connection with his duties, he preferred Criminal Misc. Application No.220 of 2024 before the learned Additional Sessions Judge, Sabarkantha at Idar, seeking modification of the said condition. However, the learned 2nd Additional Sessions Judge, Sabarkantha at Idar, vide order dated 10.05.2024, rejected the said application. Learned advocate submits that the applicant is now seeking modification of the aforesaid condition to the limited extent of permitting him to travel outside the State of Gujarat without obtaining prior permission of the concerned Sessions Court, while retaining the requirement of obtaining prior permission before leaving the territory of India.

5. Learned APP Ms. C.M. Shah appearing for the respondent – State fairly submits that appropriate orders may be passed in the interest of justice.

Application No. 13442 of 2015 is hereby modified to the extent that the restriction upon the applicant from leaving the State of Gujarat is deleted. However, the applicant shall not leave India without obtaining prior permission of the concerned Sessions Court.

7. All other conditions imposed vide order dated 19.08.2015 passed in Criminal Misc. Application No. 13442 of 2015 shall remain unchanged and continue to bind the applicant.

8. Present application stands disposed of accordingly. Rule is made absolute. Direct service is permitted. (S. V. PINTO,J) VASIM S. SAIYED
