ORDER
1. Rule returnable forthwith. Present application is filed by the applicant – State of Gujarat for condonation of delay of 60 days caused in preferring Criminal Appeal against the judgment and order of acquittal.
2. Though served, none has remained present on behalf of the respondent.

Having heard the learned APP appearing for the applicant-State and having considered the averments made in this application, the delay of 60 days in preferring the Criminal Appeal is hereby condoned.
