HDFC Ergo General Insurance Co. Ltd. Vs. Chandni Pandey & ors. FAO(MV) No.7 of 2026 09.10.2026 Present: Mr. Jagdish Thakur, Advocate, for the appellant. Ms. Pallavi Sharma, Advocates, for respondents No.1 to 4. None for respondent No.5. CMP No.25730 of 2026 The instant application has been filed on behalf of applicants/respondent No.2, 3 & 4, namely, Uttkarsh Pandey, Rekha and Dhruv Pandey, respectively, for release of the awarded amount of compensation, lying deposited in the Registry of this Court.
2. Since applicant/respondent No.2, Uttkarsh Pandey, is minor, therefore, his share cannot be released at this stage.
3. As per the applicants/respondents No.3 & 4, they are in dire need of money to meet out their day-to-day expenses. Therefore, it is prayed that the awarded amount of compensation, falling in their respective shares, may be released in their favour.
4. No reply is intended to be filed. However, learned counsel for the non-applicant/appellant has opposed the application on the ground that in the event of appeal being allowed, it would be difficult for the non-applicant/appellant to recover the amount, so released.
5. Heard. Having perused the averments made in the application, which is duly supported with the affidavits of applicants-respondents No.2 & 3 and also in view of the fact that the appeal may take sufficiently long time for its final adjudication, this Court finds it in the interest of justice to release 30% of the amount alongwith up-to-date interest, in favour of each of the applicants/respondent No.3 & 4, out of their respective shares in the total awarded amount of compensation, which is lying deposited in the Registry of this Court, after proper verification and identification by remitting the same to their respective bank accounts, details whereof have been given in para-6 of the application.
6. It is made clear that release of the awarded amount shall be subject to final outcome of the appeal and in the event of appeal being allowed, the applicants/respondent No.2 & 3 will have to refund the amount, so released, with interest.
The application stands disposed of.
