Uttrakhand State Transport Corp. Vs. Geeta Devi & ors. FAO(MV) No.207 of 2025 07.10.2026 Present: Mr. Rahul Mahajan, Advocate, for the appellant. Mr. Vinod Chauhan, Advocate, respondents No.1 &

2. As per report of the Registry, notice has been issued to respondent No.3 for 15.10.2026.

2. Therefore, list the case before the Additional Registrar (Judicial) on 15.10.2026. CMP No.17028 of 2026

3. The instant application has been filed on behalf of applicants-respondents No.1 & 2, for release of the awarded amount of compensation lying deposited in the Registry of this Court. As per the applicants, they are in dire need of money to meet out their day-to-day expenses. Therefore, it is prayed that atleast 50% of the awarded amount of compensation may be ordered to be released in their favour, as per their respective shares.

4. Reply not filed, despite repeated opportunities. However, learned counsel for the non-applicant/ appellant has opposed the application on the ground that in the event of appeal being allowed, it would be difficult for the non- applicant/appellant to recover the amount, so released.

5. Heard. Having perused the averments made in the application, which is duly supported with the affidavits of applicants-respondents No.1 & 2 and also in view of the fact that the appeal may take sufficiently long time for its final adjudication, this Court finds it in the interest of justice to release 30% of the amount, alongwith up-to-date interest, in favour of each of the applicants/respondents No.1 & 2, out of their respective shares in the total awarded amount of compensation, which is lying deposited in the Registry of this Court, after proper verification and identification by remitting the same to their respective bank accounts, details whereof have been given in para-5 of the application.

6. It is made clear that release of the awarded amount shall be subject to final outcome of the appeal and in the event of appeal being allowed, the applicants/respondents No.1 & 2 will have to refund the amount, so released, with interest.

The application stands disposed of.
