Pitamber Singh vs. Vas Dev

CMP (M) No. 2053/2025

07.10.2026 Present: Mr. R. P. Singh, Advocate, for the applicant.

Respondent No.1 ex-parte.

CMP (M) No. 2053/2025

As per report of the registry, respondent Nos. 2(a) to 2 (c) stand duly served, however there is no appearance on their behalf. Therefore, they are proceeded ex-parte.

The present application has been filed for condonation of delay in filing the main appeal. It has been averred in the application that even though copy of the impugned judgment, dated 28.06.2025 was supplied to the applicant on 31.08.2025, however inadvertently copying agency mentioned date of delivery of the aforesaid judgment as 31.07.2025. Thereafter, he visited the copying agency and accordingly, prompt action was taken for preparation of the appeal. Therefore, the aforesaid delay is neither intentional nor deliberate, but has occurred due to unavoidable circumstances, which were beyond the control of the applicant.

For the reasons stated in the application, more particularly, paras 2 to 4 thereof, which is duly supported by an affidavit, coupled with submissions made by the learned counsel for the applicant, delay in filing the main appeal is condoned. Appeal be registered. Application stands disposed of.
