...Respondents

Coram:

The Hon’ble Mr. Justice Romesh Verma, Judge. Whether approved for reporting?1 For the petitioner : Mr. Ganesh Barowalia, Advocate.

For the respondents : Mr. Balram Sharma, Deputy Solicitor General of India with Dr. Sahil Malhotra, Advocate, for respondent No.1.

Mr.P.S. Goverdhan, Senior Advocate with Mr. Rakesh Thakur, Advocate, for respondents No.2 to 5.

Romesh Verma, Judge (oral):

During the course of arguments, it is contended by Mr.Balram Sharma, learned Deputy Solicitor General of India, that he has positive instructions to submit that the Union of India has no role of any kind in the present proceedings. He further submits that the Union of India has been unnecessarily arrayed as a party defendant/respondent in the present proceedings.

3. Faced with this situation, learned counsel for the petitioner submits that he may be permitted to delete the name of Union of India from the array of parties before the learned trial Court and thereafter the suit can be adjudicated by the learned trial Court on its own merits.

4. Consequently, the instant petition is disposed of with liberty to the petitioner to file an appropriate application before the learned trial Court for deletion of the name of Union of India and thereafter the learned trial Court is directed to proceed in the matter in accordance with law.

5. Pending application(s), if any shall also stand disposed of.
