Counsel for the State restricts the claim only to the fact that consequential benefits which have been directed to be given for the period of three years prior to the filing of the writ petition would not be sustainable. Keeping in view the fact that the Apex Court in Civil Appeal No. 1595 of 2025, titled State of H.P. and others vs. Surajmani and another, decided on 6th February, 2025, has directed that the benefit, as such, to the employees in question for the work charge would be notional, it is submitted that after the passing of the order by the learned Single Judge, the State has already given the work charge status on completion of eight years service on 8th October, 2025, which order has been placed on record. The employee having joined on 1st June, 1992 and completed the requisite 240 days in the year 1993, thereafter, had initially been granted the benefit of the work charge status from 1.1.2003, which has now been modified to 1.1.2001. It is also pointed out that Execution Petition No. 1039 of 2026 has been filed and is to be listed on 26th October, 2026.
In view of the request, the hearing on the said Execution Petition would be deferred. Liberty is also given to serve the respondent through Counsel Mr. Devender K. Sharma, Advocate, appearing for the petitioner in the Execution Proceedings.
On taking steps within one week, issue notice to the respondent, returnable for 2nd December, 2026.
