……...Petitioner Versus State of Himachal Pradesh & Ors. …....Respondents

Coram

Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? Yes.

For the Petitioner: Ms. Shreya Chauhan, Advocate.

For the respondent: Mr. Rajan Kahol & Mr. Vishal Panwar, Additional Advocates General with Mr. Ravi Chauhan & Mr. Anish Banshtu, Deputy Advocates General, for the respondents- State. ___________________________________________________________________________

Sandeep Sharma, J. (Oral)

Learned counsel representing the petitioner fairly states that though after filing of the petition at hand, necessary assistance/permission has been rendered/granted by respondents No. 1 to 4, enabling the petitioner, NHPC Limited, to repair the valve house of Parbati-II Power Station at Adit-V, near RD 14,000 metre, Suind- Raila, Sainj, District Kullu, but since considerable time is likely to be consumed in concluding the repair work, coupled with the fact that path, which was obstructed/blocked by respondent No. 7, leads to the powerhouse, necessary directions are required to be issued to respondent No. 7 to ensure that no obstruction to the passage leading to the powerhouse is caused by the residents of the Gram Panchayat.

2. While putting in appearance on behalf of respondents No. 1 to 6, Mr. Anish Banshtu, learned Deputy Advocate General, states that immediately after receipt of the request from the petitioner, passage, which was allegedly blocked by respondent No. 7, has been opened. He states that no obstruction would be permitted by anyone, including respondent No. 7, on the road leading to the powerhouse.

3. Consequently, in view of the aforesaid fair stand adopted by the learned Deputy Advocate General, this Court sees no reason to keep the present petition alive and accordingly, the same is disposed of with a direction to respondents No. 2 to 4 to ensure that no hardship is caused to the petitioner, while repairing the valve house of Parbati-II Power Station at Adit-V, near RD 14,000 metre, Suind-Raila, Sainj, District Kullu, which has been damaged due to sudden discharge of water and in that regard, appropriate action in accordance with law against the erring persons, including respondent No. 7, if required, be taken.

4. In the aforesaid terms, present petition is disposed of along with pending applications, if any.
