Whether reporters of Local Papers may be allowed to see the judgment? Yes.

with Section 34 of the Indian Penal Code (IPC), based on a compromise entered into between the parties.

2. It has been asserted that petitioner No. 1 and respondent No. 2 (the informant/victim) are husband and wife. The dispute had arisen between them, leading to the registration of the FIR. Now, all the parties have settled the matter amongst themselves and are residing happily with each other. The informant/victim does not wish to proceed further with the matter after the compromise.

3. The statement of the informant, Smt. Sobiya, was recorded on 24.08.2026, wherein she stated that she had entered into a compromise with the petitioners voluntarily, without any influence or pressure, and that she does not want to proceed further with the matter.

4. The offences punishable under Sections 406 and 506 of the IPC are compoundable under Section 320 of the Code of Criminal Procedure (CrPC). Section 320(3) of the CrPC provides that when an offence is compoundable and a person is liable under Section 34 of the IPC, the offence may be compounded. Therefore, the offences punishable under Sections 406 and 506

read with Section 34 of the IPC can be compounded based on the compromise arrived at between the parties.

5. The offence punishable under Section 498A of the IPC arises out of a matrimonial dispute and FIR registered for the commission of offence punishable under Section 498A of IPC can be quashed based on a compromise as per the judgment in Gian Singh versus State, 2012 (10) SCC 303, Narender versus State of Punjab, 2014 (16) SCC 466, Vikas Singh vs. State of H.P. (2023)I DMC 335 (HP) and Sanjay Kumar vs. State of H.P2023 (1) Him L.R. 602, which are binding upon this Court.

6. In view of these binding precedents, the present petition is allowed, and the FIR No. 174 of 2019, dated 03.11.2019, registered at Police Station Majra, District Sirmaur, H.P., for the commission of offences punishable under Sections 498A, 406, and 506 read with Section 34 of the IPC is ordered to be quashed. Consequent upon the quashing of the FIR, criminal proceedings pending/initiated against the petitioners-accused in pursuance thereto are also ordered to be quashed.

7. Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any.

8. Parties are permitted to produce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh, before the authorities concerned, and the said authorities shall not insist on the production of a certified copy, but if required, may verify passing of the order from the Website of the High Court.
