State of H.P. through Secretary & another vs. Tilak Raj OMP(M) No.63 of 2026

01.10.2026 Present: Mr. Baldev Singh Negi, Addl. A.G., for the applicant. Mr. R.L. Chaudhary, Advocate, for the respondent.

OMP(M) No.63 of 2026

The instant application has been filed for condonation of delay in filing the instant appeal, which is barred by 22 days. It has been contended in the application that the impugned judgment was passed by the learned District Judge, Mandi on 01.08.2025 and the copy of the same was received on 22.08.2025 by the Executive Engineer, Banjar Division, HP Public Works Department. Thereafter, the same was considered and after visualising its implication, it was decided that an appeal has to be filed against the said judgment. Immediately, the appeal was prepared and the same was vetted by the District Attorney (PWD), office of Engineer-in- Chief, HP Public Works Department, Shimla on 17.10.2025 and thereafter the appeal was finally vetted by the office of learned Advocate General on 18.10.2025. The appeal was filed before this Court and in this process, delay has occurred, which is neither intentional nor willful, but the same has occurred under unavoidable circumstances.

The learned counsel for the non-applicant has no objection in case the present application is allowed.

Consequently, in view of the averments made in the application, which is duly supported by an affidavit, and in view of the submissions made by the learned vice counsel for the applicant, the present application is allowed and the delay in filing the appeal is condoned.

Accordingly, the application stands disposed of.
