OMP(M) No.369 of 2026

01.10.2026 Present: Mr. Santosh Kumar, Advocate, vice counsel, for the applicant. Mr. Suneet Verma, Advocate, for respondent No.1. Mr.Manish Thakur, Dy. A.G., for respondent No.2.

OMP(M) No.369 of 2026

The iinstant application has been filed for condonation of 62 days’ delay in filing the appeal. It has been contended in the application that the impugned judgment was passed by the learned District Judge, Mandi on 12.11.2025. Certified copy of the judgment was applied for by the learned counsel on 12.12.2025 and the same was prepared and delivered on 18.12.2025. Due to inadvertence and oversight, the certified copy got misplaced and could not be traced despite best efforts. The misplacement of the certified copy was neither deliberate nor intentional, but occurred due to bona fide circumstances. Upon retrieval of certified copy after diligent search, steps were immediately taken for filing the appeal.

The learned counsel for the non-applicants have no objection in case the present application is allowed.

Consequently, in view of the averments made in the application, which is duly supported by an affidavit, and in view of the submissions made by the learned vice counsel for the applicant, the present application is allowed and the delay in filing the appeal is condoned.

Accordingly, the application stands disposed of.
