NHAI vs. Draupadi Devi & another

OMP(M) No.410 of 2025

01.10.2026 Present: Mr. Santosh Kumar, Advocate, vice counsel, for the applicant.

OMP(M) No.410 of 2025

As per report of the Registry, respondents stand served, but none has put in appearance on their behalf. Hence, they are proceeded against ex parte.

The instant application has been filed for condonation of 335 days’ delay in filing the present appeal. It has been contended in the application that the impugned judgment was passed by the learned District Judge, Mandi on 03.06.2024. Certified copy of the judgment was applied by the counsel for the applicant on 01.07.2024 within the period of limitation and the same was delivered on 29.08.2024. The copy of the judgment was supplied to the office of the applicant and steps were taken for engaging the counsel for filing the appeal. In this process, delay has occurred in filing the appeal, which is neither intentional nor willful, but the same has occurred under unavoidable circumstances.

Consequently, in view of the averments made in the application, which is duly supported by an affidavit, and in view of the submissions made by the learned vice counsel for the applicant, the present application is allowed and the delay in filing the appeal is condoned.

Accordingly, the application stands disposed of.
