NHAI vs. Hari Ram

OMP(M) No.282 of 2026

01.10.2026 Present: Ms. Sneh Bhimta, Advocate, vice counsel, for the applicant. Mr. Hitender Verma, Advocate, for the respondent.

OMP(M) No.282 of 2026

The instant application has been filed for condonation of 519 days’ delay in filing the present appeal. It has been contended in the application that the impugned judgment was passed by the learned District Judge, Mandi on 02.09.2024. The certified copy of the judgment was applied on 07.10.2025 and the same was delivered on 18.10.2025. As per the case set up by the applicant, the disposal of the case was not within the knowledge of the applicant.

Earlier also, due to the inefficiency and lackadaisical attitude of the law firm, as many as 362 cases pending in Districts Mandi and Bilaspur were withdrawn from the law firm, namely M/s M.V. Kini & CO. and those were allotted to M/s Nishaank Mattoo & Associates, vide letter dated 20.09.2023. Due to lack of cooperation from the counsel, the delay has occurred in filing the present appeal, which is neither intentional nor willful, but has occurred under bona fide circumstances.

The learned counsel for the non-applicant has no objection in case the present application is allowed.

Consequently, in view of the averments made in the application, which is duly supported by an affidavit, and in view of the submissions made by the learned vice counsel for the applicant, the present application is allowed and the delay in filing the appeal is condoned.

Accordingly, the application stands disposed of.
