CMP No. 25807 of 2026 in CWP No. 16346 of 2026

01.10.2026 Present Mr. V.S. Chauhan, Senior Advocate with Mr. Arsh Rattan, Advocate, for the applicant/petitioner.

Mr. Anup Rattan, Advocate General with Mr. Rajan Kahol, Additional Advocate General, for the respondents-State.

Mr. Manoj Kumar Verma, Assistant Commissioner (Excise) Solan, Himachal Pradesh, present in person.

By way of instant application filed under Section 151 CPC, prayer has been made on behalf of the applicant/petitioner for extension of time to comply with direction No. 2 contained in the judgment dated 18.09.2026 passed by this Court in CWP No. 16346 of 2026, titled Rohit Chauhan & Co. vs. State of Himachal Pradesh and others.

Mr. Anup Rattan, learned Advocate General, who has put in appearance on behalf of the respondents, states that though in terms of judgment dated 18.09.2026, there is no scope, if any, for extension of time, but by way of indulgence and subject to the statement/undertaking given to this Court by the applicant/petitioner that in any eventuality, he shall deposit sum of Rs. 2, 85, 66,224/- on or before 15.10.2026, his prayer for extension of time may be allowed.

Having carefully perused the judgment dated 18.09.2026 passed by this Court, there appears to be no justification to grant further time, but by way of indulgence and taking note of undertaking/statement given by the applicant/petitioner before this Court, this Court grants time till 15th October, 2026 to the applicant/petitioner to deposit the amount, as indicated hereinabove, failing which he would render himself liable for penal consequences as well as contempt of the Court and non-applicants/ respondents would be at liberty to seal the vend. It is made clear that no further request for extension of time shall be entertained and rest of the conditions as mentioned in condition No.2 of the judgment, as detailed hereinabove, shall remain the same and applicant/petitioner will fulfill the same in accordance with the judgment dated 18.09.2026. Till 15.10.2026, no coercive action shall be taken against the applicant/petitioner. The application stands disposed of.
