Mr. Maan Singh, Advocate, for respondents No. 1 to 3. Mr. Diwakar Dev Sharma, Additional Advocate General, for respondents No. 4 and 5. OMP(M) No. 508 of 2026 The instant application has been filed under Section 5 of the Limitation Act for condonation of delay in filing the appeal. It has been stated in the application that there is a delay of 9 days in filing the instant appeal. It is averred that after the pronouncement of the judgment on 12th March, 2026, the certified copy was applied on 6th April, 2026 and delivered on 29th April, 2026. The applicants were pursuing the matter diligently and the delay of 9 days was neither intentional nor deliberate, but due to unavoidable circumstances which were beyond the control of applicant. Learned counsel appearing for the respondents have no objection in case the present application is allowed. Consequently, in view of the averments as made in the application, which is duly supported by an affidavit, and keeping in view the fact that the learned counsel for the non- applicants have no objection, the present application is allowed and the delay in filing the appeal is condoned. The application stands disposed of. Arb. Appeal No.____/2026 (Filing No. ARB.A/36210/2026) Appeal be registered. Heard. Admit. List for hearing in due course.
