OMP(M) No.610 of 2026

23.09.2026 Present: Ms. Ruchika Negi, Advocate, vice counsel, for the applicant. Mr. Baldev Singh Negi, Addl. A.G., for respondent No.1. Mr. Narender Guleria, Advocate, for respondents No.2 and 3.

OMP(M) No.610 of 2026

This application has been filed for condonation of 34 days' delay in filing the present appeal. A perusal of the application reveals that the judgment was passed by the learned District Judge on 09.04.2026. The certified copy of the judgment was applied and the same was supplied on 05.06.2026. Unfortunately, the said copy got intermingled with other papers and the same could be retrieved after great difficulty. The delay in filing the appeal is neither intentional nor willful but is due to the reasons stated in the application.

Learned counsel for the non-applicants have no objection in case the application is allowed in favour of the applicant.

Consequently, in view of the averments made in the application, which is duly supported by an affidavit, and in view of the submissions made by the learned counsel for the applicant, the delay in filing the appeal is condoned. Accordingly, the application is allowed
