This application has been filed by the respondent- applicant for release of the amount which stands deposited by the non-applicant/appellant in the Registry of this Court.
For the reasons as stated in the application which is duly supported by an affidavit and in view of the submissions as made by learned counsel for the respondent-applicant, it is ordered that 50% of the total decretal amount which stands deposited in the Registry of this Court, along with up-to-date interest, be released by remitting the same in the saving bank account of the applicant, the particulars whereof have been given in para-6 of the application. The said amount shall be remitted to the respondent on his furnishing an affidavit within a period of two weeks from today to the satisfaction of the learned Registrar (Judicial) that in case any order is passed against the respondent-applicant, in that event, it shall be liable to refund the entire amount, along with up-to-date interest. The application stands disposed of.
