Versus Sanjeev Soni & others

...Defendants

Coram:

The Hon’ble Mr. Justice Romesh Verma, Judge. Whether approved for reporting?1 For the plaintiff : Mr. Janesh Gupta, Advocate.

For the defendants : Mr. Dushyant Dadwal, Advocate, for defendants No.1 to 4.

Romesh Verma, Judge (oral):

It is contended by the learned counsel for the plaintiff that he has instructions to submit that, as regards the suit land which stood partitioned on the strength of the report whereby Mr. Laxshman Dass Kondal was appointed as the Court Commissioner, it has been agreed upon that the parties shall remain bound by the terms and conditions as well as the finality of the said partition inter se them.

2. It has been further contended that so far as the remaining unpartitioned land is concerned, it has been agreed upon that the same shall remain intact and the parties shall be at liberty to take recourse to law, in accordance with law, if so required, except in respect of the land as mentioned in para-3 of the preliminary objections and para-1 on merits of the written statement.

3. Learned counsel for the plaintiff submits that he has instructions to withdraw the present civil suit in view of the statements made hereinabove.

4. Needless to say, the partition which has already been conducted by Mr. Laxshman Dass Kondal inter se the parties shall be taken to its logical end by the revenue authorities in the event of an appropriate application being filed before them. In the event of doing so, the revenue authorities are directed to pass final order within a period of four weeks from today.

5. With these observations, the present civil suit is disposed of as having been withdrawn along with pending application(s), if any. .
