NHAI vs. Sunder Nagar Integrated Rural Development Association Arb. Appeal No.238 of 2025

11.09.2026 Present: Ms. Sneh Bhimta, Advocate vice counsel, for the appellant. Ms. Annanya Verma, Advocate, vice counsel, for the respondent.

OMP No.911 of 2026

The instant application has been filed for the release of the amount of compensation in the decided matter. It has been contended in the application that since the appeal stands finally decided on 28.11.2025 and thereafter the judgment has attained finality as the non- applicant has not assailed the same before the Hon’ble Apex Court. No useful purpose shall be served in case the entire awarded amount lying deposited in the Registry of this Court is retained in the Registry. It has been further contended that the applicant requires the amount of compensation for daily expenses.

The fact that the judgment passed by this Court has not been assailed before the Hon’ble Apex Court has been duly acknowledged by the learned counsel for the non-applicant.

Consequently, in view of the averments made in the application, which is duly supported by an affidavit, the entire awarded amount lying deposited in the Registry of this Court, along with up-to-date interest, is ordered to be released by remitting the same in the savings bank account number as mentioned in para-10 of the application. Accordingly, the application stands disposed of.
