Date of Decision: 31.08.2026 _____________________________________________________________________ Ram Chand

……...Petitioner Versus HP State Electricity Board Ltd. & Ors. …....Respondents

Coram

Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? Yes.

For the Petitioners: Mr. Vishwa Bhushan, Advocate.

For the respondents: Mr. V.S. Kanwar, Advocate. ___________________________________________________________________________

Sandeep Sharma, J. (Oral)

Precisely, the grouse of the petitioner, as has been highlighted in the petition and further canvassed by Mr. Vishwa Bhushan, learned counsel for the petitioner, is that two towers were erected on the land of the petitioner in the year 2012 for laying a transmission line for the 132 KV Single Circuit Transmission Line from Jahu to Bhota, but till date, he has not been paid compensation qua the same. Though careful perusal of communication dated 06.02.2025 (Annexure P-2) clearly reveals that sum of Rs.10,41,062/- is due to the petitioner, but till date, same has not been released for reasons unknown to the petitioner and as such, he is compelled to approach this Court in the instant proceedings.

2. While putting in appearance on behalf of the respondents, Mr. V.S. Kanwar, learned counsel for the respondents, states that

2 though he has every reason to believe and presume that by now, aforesaid amount must have been released, but if not, same shall be released expeditiously, preferably within a period of six weeks.

3. In view of aforesaid fair statement adopted by learned counsel for the respondents, present petition is disposed of with a direction to the respondents to ensure that amount, as calculated in communication dated 06.02.2025 (Annexure P-2), is relleased to the petitioner qua use of his land for the construction of tower, failing which he shall be entitled to interest at the rate of 6% from the date aforesaid amount became due to him.
