1. 1. This matter is taken up by this Tribunal through Hybrid mode.
2. 2. Ld. counsel for the applicant has submitted that applicant has filed original application for recovery of legitimate dues for Rs. 251,05,43,508/- against the Defendants no.1 to 8, which was allowed in favour of applicant FI on 13.11.2024. It is further submitted that applicant want to get back the original documents filed along with OA. Hence, this application has filed for return of the original documents filed along with the OA and prayed that the present application be allowed and original documents be return to the applicant FI (IREDA).
3. 3. Ld. counsel for the Applicant has further submitted that matter is also settled before the Recovery Officer by order dated 21.04.2025, copy of order is also filed by dy. No. 1508/2025.
4. 4. Considering the submissions on behalf of Ld. counsel for the applicant FI. It is clear that documents which were filed in support of original application has disposed of in favour of applicant and even the recovery proceedings are also finalized by order of Ld. Recovery Officer. After finalizing of proceedings before DRT, documents can be return to the applicant as per the rules. Hence, MA no. 23/2025 is hereby allowed. The Registry is directed to return the documents in favour of applicant as per Rules.
