Under instructions, learned counsel for the petitioner submits that though, main grievance of the petitioner stand redressed, however, the arrears have been restricted for three years, prior to filing of present Petition, whereas present Petition is second round of litigation as petitioner had also approached the Court earlier by filing CWP No. 4344 of 2024 on 16.3.2024, which was permitted to be withdrawn vide order dated 3.3.2025 (Annexure P-12), by granting liberty to the petitioner to file afresh petition and, therefore, it has been claimed that three years period for claiming arrears of financial benefits is to be counted prior to 16.3.2024.
