ORDER

08.10.2026

1. This Court, vide order dated 07.10.2026, while noticing the absence of representation on behalf of the petitioners, had adjourned the matter in the interest of justice and made it clear that, in the event of their failure to appear on the next date of hearing, the petition would be taken up and decided on merits.

2. Today, despite the matter having been specifically fixed for the aforesaid purpose, none appears on behalf of the petitioners nor there is any request for adjournment.

3. On the last date of hearing, Mr. Ravinder Gupta, learned AAG, had produced a communication dated 05.10.2026, wherein it was stated that the construction of the road from KM 5th of Phamranar-Parat Road, Karnah Parat, JK11-4512, PMGSY-IV, Batch-I, 2026-27, is in WP(C) No. 3189/2026

progress, however, no construction activity has been undertaken by the department on the land claimed by the petitioners.

4. In view of the aforesaid position, particularly the categorical stand of the respondents that no construction activity has been undertaken on the land claimed by the petitioners, coupled with the fact that the petitioners have chosen not to appear despite the matter having been specifically fixed for consideration, nothing survives for consideration in the matter. Accordingly, the instant writ petition is dismissed.
