ORDER

07.10.2026

1. The petitioners claiming to be the owner in possession of land measuring 104 kanals, falling under survey Nos. 42 & 422, situate at village Lalyal, Tehsil Marh, District, Jammu. The precise grievance of the petitioners is that, despite having approached the Tehsildar, Marh for demarcation of the said land, the needful has not been done. On the other hand, learned counsel for the respondents submits that, having regard to the nature of the dispute, the same cannot be adjudicated in the extraordinary jurisdiction of this Court, particularly when petitioners admit that they are the non-residents of the UT of J&K.

2. Be that as it may, there is a complete mechanism provided under the Land Revenue Act for demarcation of the land. Therefore, they are required to approach the competent authority for demarcation of the said land. However, it appears that despite an application having been filed by the petitioners, the needful has not been done, leading to the filing of the present petition. Sr. No. 17

2 WP(C) No. 2480/2024

3. Keeping in view the prayer made by the petitioners, this petition is disposed of with a direction to the respondents, particularly respondent No. 4, to proceed in the matter in terms of Chapter IX of the Land Revenue Act, Svt. 1996, if petitioners satisfy the statutory conditions for exercise of such power, and to proceed in accordance with law.

4. Disposed of, accordingly.
