ORDER

05.10.2026

1. The petitioners have invoked the extraordinary jurisdiction of this Court under Section 528 of the Bharatiya Nagrik Suraksha Sanhita, 2023 (BNSS), seeking quashing of Challan No. 266/2024 dated 10.01.2024 arising out of FIR No. 189/2020 registered at Police Station, Bakshi Nagar, Jammu, under Sections 341, 323, 354-B, 294, 504, 506, 34 of the Sr. No. 12

IPC. The petitioners have approached this Court seeking intervention precisely on the ground that since the parties have entered into a compromise, therefore, continuation of the proceedings would amount to abuse of the process of the Court.

2. Be it further noted that it has been informed by learned counsel for the petitioners that the trial is going on and the matter is pending for prosecution evidence since 2024.

3. From the averments contained in the petition, coupled with the submissions made at Bar, it appears that the parties alleged to have entered into a compromise, but the trial Court perhaps has taken some time, which has necessitated the petitioners to approach this Court.

4. Once the trial Court is seized of the matter, the parties cannot be allowed to circumvent the due process of law. In this view of the matter, this petition is disposed of with a direction to expedite the trial and, after fixing the calendar, let the matter be wrapped up within a period of one month by holding day-to-day proceedings and pass the appropriate order in accordance with law. Let this order be forwarded to the learned trial Court for compliance.

5. Disposed of, accordingly.
