ORDER

29.09.2026

01. Having been confronted with the submissions made by the learned counsel for the respondent-Mr. Swarn Kishore Singh that the judgment, which is assailed in this appeal, was subject matter of challenge in LPASW No. 160/2016, which stands dismissed by a Division Bench of this Court on 17.11.2016, the appellant apologized and placed himself at the mercy of this Court. He also prayed for withdrawal of this appeal unconditionally.

02. Having regard to the remorse shown by the appellant, who is appearing in person and seeking permission to withdraw the appeal, we are taking a lenient view in the matter.

Sr. No. 06

2

03. The appeal, which is sought to be withdrawn, is otherwise not maintainable on the principle of res judicata, as the judgment has already attained finality with dismissal of LPASW No.160/2016, by the Division Bench of this Court on 17.11.2016.

04. Tthe present appeal is, accordingly, dismissed.
