1. The order impugned in this petition filed under Article 227 of the Constitution of India, is an interim order subject to objections from other side i.e, petitioner herein. The petitioner has a remedy of filing response before the court of learned 2nd Civil Subordinate (Sr. Division) PT & E, Srinagar.
2. Accordingly, the present petition is disposed of by permitting the petitioner to file response to the application wherein the impugned order has been passed and after the response is filed, the trial court shall decide the same in accordance with aw within the period prescribed under the Code of Civil Procedure.
3. Disposed of as above.
