HIGH COURT OF JAMMU & KASHMIR AND LADAKH

AT SRINAGAR

CRM(M) 816/2026

HEENA SULTAN

Appellant(s)/Petitioner(s)

Through: Mr. Abu Owais Pandit, Advocate.

Vs.

RAYEES AHMAD GUNA

...Respondent(s)

Through: None.

CORAM: HON’BLE MR. JUSTICE YASH PAUL BOURNEY, JUDGE

ORDER

05.10.2026

1. The learned counsel for the petitioner has stated, at the very outset, that this petition can be disposed of immediately, without waiting for the other side, simply by issuing directions to the court below to expedite the disposal of the execution application, which has been pending for quite some time.

2. The record reflects that the petitioner had been granted interim maintenance by the trial court, however, respondent is not regular in making payment thereof, thereby forcing petitioner to approach the trial court again and again. It is in the given circumstances that petitioner has invoked jurisdiction of this court.

3. There cannot be a second opinion that maintenance, whether interim or final, is granted to make it possible for the aggrieved party to meet her urgent day-to-day needs, so it has to be paid ceremoniously so that the aggrieving party is not led to vagrancy.

4. In this view of the matter the petition is disposed of with the directions to the trial court to expedite the disposal of the application for execution and also to ensure that the maintenance allowance, whatever is awarded, is paid on time. It shall be appreciable if the applications pending before the court below are disposed of within the period of two months.

5. Disposed of.

;

(YASH PAUL BOURNEY)

JUDGE
