WP(C) 340/2024 CM(4224/2025)

GHULAM MOHAMMAD RATHER.

…Petitioner (s)

Through:

Mr. Syed Abdul Imam Muizz, Adv.

VERSUS

UNION TERRITORY OF J AND K AND ORS

Through:

Mr. Waseem Gull, GA.

…Respondent(s)

CORAM:

HON’BLE MR. JUSTICE RAJNESH OSWAL, JUDGE.

ORDER

30-09-2026

1. The relief claimed by the petitioner in the present petition is for regularisation of his services as Follower/Constable. The petitioner had earlier approached the learned Central Administrative Tribunal and OA preferred by the petitioner was disposed of by the learned Tribunal in terms of order dated 16-02-2026, after recording the submissions made by the Mr. Waseem Gull, Government Advocate, that the dispute is not cognizable by Central Administrative Tribunal. This is how the petitioner has filed this petition.

2. Mr. Waseem Gull, Government Advocate, who incidentally is representing the respondents in this case as well, has very fairly conceded that the dispute involved in the present petition is cognizable by the Central Administrative Tribunal and due to inadvertence the above submissions were made before learned Central Administrative Tribunal. Accordingly, this writ petition is transferred to Central Administrative Tribunal, Srinagar, where the parties shall appear on 21-10-2026.
