ORDER

29-09-2026

01. The whole controversy in the petition revolves around the respective merit of the petitioner and respondent No.4. The petitioner claims to be more meritorious than respondent No.4.

02. The official respondents have filed their objections and respondent No.4 has adopted the same as response on her behalf in terms of Order dated 22nd of May, 2026.

03. The respondents in their response have stated that the merit of the petitioner could not be determined as the petitioner had only submitted the grade card of Class 10th and not the marks card. It is further stated that no engagement order for the above-mentioned post has been issued till date.

04. Heard learned counsel for the parties and perused the record.

05. The petitioner has only impugned the tentative selection list wherein respondent No.4 has been shown to have been selection for the post of Anganwadi Helper at Centre Zalisidara Jabad Brenwara, Chadoora District Budgam. It is also admitted by the learned counsel appearing for the petitioner that the petitioner did not file any objection before the authority concerned regarding the tentative selection list dated 31st of July, 2023.

06. In view of the above, no fruitful purpose shall be served by retaining the present petition on board. Accordingly, the present petition is disposed of by directing the respondent No.3 to consider the claim of the petitioner as well as respondent No.4 with regard to their respective qualifications and eligibility and pass appropriate orders in accordance with the law, after affording due opportunity of hearing to both the contesting parties.

07. Disposed of along with connected CMs.
