ORDER

26.09.2026

1. After hearing learned counsel for the parties for some time, it was brought to the notice of this Court by the counsel for the respondents that the charge sheet has already been filed on 15th September, 2026, before the Court of Special Mobile Magistrate, Budgam.

2. Since the petitioner is accused of an offence punishable with imprisonment for a term of less than seven years, the counsel for the petitioner submits that the petitioner is ready to surrender before the trial court for regular further proceedings, and seeks protection in the meanwhile.

3. It is noted that, while approaching the Court of Sessions at Budgam, the petitioner was granted interim protection with a direction to apply for regular bail. However, instead of approaching the said court for regular bail, the petitioner has filed the instant petition seeking grant of anticipatory bail.

4. Since the charge sheet has already been laid, the petitioner is granted ten days' time to appear before the trial court, enabling the latter to proceed further with and regulate the appearance of the petitioner in accordance with law.

5. Disposed of.
