ORDER
25.09.2026
1. Petitioner has invoked supervisory jurisdiction of this Court under Article 227 of the Constitution of India, to assail order passed by learned Munsiff/JMIC Ganderbal [for short „the trial court‟] on 08.12.2023 in suit titled “Nasreena Begum Vs. Syed Ruhullah Shah & Ors.” under Order XXXIX, Rule 1 & 2 CPC.
2. The impugned order passed by the trial court, in terms of Order XXXIX Rule 1 & 2 CPC, on the face of it, is appealable under Order XLIII CPC, but the petitioner has straightway approached this Court, without availing the statutory remedy of appeal.
3. In view of the above, present petition is dismissed, along with connected CMs.
4. Interim direction, if any, shall stand vacated.
