ORDER

22.09.2026

1. After arguing for a while, learned counsel for the petitioners submits that the petitioners would feel satisfied in case the representation which they intend to file before respondent No.2 (Officer Highway Administration (Project Director), near Bali Printing Press, Maitra, Ramban) and respondent No.3 (Collector Land Acquisition, District Anantnag), with respect to the shops which have allegedly been demolished by the respondents while expanding the construction of the National Highway, is considered and decided within a reasonable time frame.

2. On the asking of the Court, Mr. Mohsin-ul-Showkat Qadiri, learned Sr. AAG, has caused appearance on behalf of respondent No.3, and Mr. Shuja- ul-Haq, learned Advocate, has caused appearance on behalf of respondents 1 and 2. Learned counsel for the respondents is not averse to disposal of the present writ petition in the manner proposed by learned counsel for the petitioners. However, they submit that the representation of the petitioners shall be considered strictly in accordance with law and the rules governing the field.

3. In view of the innocuous prayer made by learned counsel for the petitioners and with the consent of learned counsel for the parties, this Court deems it appropriate to dispose of the present writ petition by directing the petitioners to file a detailed representation before respondents 2 and 3, projecting their grievance and highlighting the details of the shops and land, along with the necessary documents, within one week. Subject to filing of such representation, respondents 2 and 3 shall consider and decide the same strictly in accordance with law and the rules governing the field, within a period of four weeks thereafter, from the date a copy of this order, along with all relevant annexures, is made available to them.

4. It is further directed that, before passing an order on the representation, the petitioners shall be afforded an adequate opportunity of being heard. The order so passed shall be communicated to the petitioners within one week thereafter through registered post.

5. Disposed of in the manner indicated above.
