1. This petition has been filed by the petitioner seeking quashing of the order dated 18th March 2025 passed by the Court of learned Chief Judicial Magistrate, Baramull at Sopore, in an application titled Abdul Rashid Dar versus Adil Ayaz Sheikh, whereby the truck bearing registration No.JK05L-3906 was released in favour of the petitioner, subject to deposit of an amount of ₹10.00 lacs in cash before the Court as security.

2. Learned counsel for the petitioner submits that the petitioner has challenged the impugned order only to the limited extent that it directs release of the vehicle in favour of the petitioner subject to deposit of an amount of Rs.10 lacs. He further submits that, in terms of order dated 7th April 2025, the condition imposed by the learned Chief Judicial Magistrate, Baramulla, Sopore, upon the petitioner to deposit an

amount of ₹10.00 lakhs was relaxed by this Court, and thereafter, the vehicle was released in favour of the petitioner.

3. As respondent No. 2 has not chosen to assail the impugned order, this Court is of the considered view that the condition imposed by the learned Chief Judicial Magistrate, Sopore, Baramulla, is harsh and ought not to have been imposed upon the petitioner.

4. Accordingly, this petition is allowed. Conditions Nos. A, G and H, imposed by the learned Chief Judicial Magistrate, Sopore, Baramulla in terms of order dated 18th March 2025, are hereby quashed.

5. The order passed by the learned Chief Judicial Magistrate is modified to the extent as mentioned above.

6. Disposed of.
