1. During the course of hearing, learned counsel appearing for the contesting parties submitted that they have reached an amicable settlement, inasmuch as the controversy with regard to the alleged gift made in favour of the petitioner is already the subject matter of a civil suit pending before the Court of learned Sub-Judge, Shopian. It is further submitted that the appellate court, i.e., the learned Principal District Judge, Shopian, has set aside the order dated 16th November, 2024 passed by the learned trial court and has restrained the private respondents from dispossessing the petitioner except by following due process of law.

2. In view of the pendency of the suit and, more particularly, in view of the issues framed by the learned trial court, the contesting parties have agreed that the present petition be disposed of with the observation that

the order impugned herein shall remain subject to the outcome of the civil suit preferred by the petitioner against the private respondents.

3. Learned counsel appearing for the petitioner has further assured this Court that the petitioner would lead evidence in the suit and would not seek any unnecessary adjournment.

4. Accordingly, the learned trial court is requested to expedite the proceedings in the suit and avoid granting unnecessary adjournments to the contesting parties.

5. It is, however, made clear that this Court has not examined the merits of the controversy or expressed any opinion thereon, and the rights and contentions of the parties shall remain open to be adjudicated by the learned trial court in accordance with law.

6. Accordingly, in view of the consensus arrived at between the contesting parties, the present petition is disposed of with the observation that the order impugned herein shall remain subject to the outcome of the civil suit pending before the learned Sub-Judge, Shopian.

7. Disposed of accordingly.
