ORDER

17.07.2026

1. This writ petition is dismissed on account of the fact that the petitioner has no locus standi to seek transfer of leasehold rights in respect of Shop No. 3 situated near Lal Ded Hospital Road, Srinagar which admittedly is a property of Srinagar Municipal Corporation (SMC) and is said to have been leased to the petitioner's father, as averred in the petition though without any proof as to under which allotment order or lease deed the petitioner's father- Ghulam Rasool Sheikh came to be vested with the leasehold rights of the shop in question, which is being used for the purpose of a pharmaceutical business in the name of M/s G. R. Pharmacy.

2. This writ petition is dismissed without prejudice to the rights of Ghulam Rasool Sheikh- the original leaseholder of the shop in question, to avail an appropriate legal remedy in the context 121 Suppl-I

sought to be projected by the petitioner by reference to his father's alleged leasehold rights. Accordingly, the petition stands dismissed.
