ORDER
30.06.2026
01. After arguing for a while Mr. M. Y. Bhat learned Senior Advocate very fairly conceded that though he has a cause of action for maintenance of the writ petition but still first option is at the disposal of the petitioner to come up with the contempt petition so as to bear true effects to the compliance of the order dated 13.07.2021, passed in OWP No. 1252/2014.
02. This Court is of opinion that contempt petition may not be an appropriate remedy available at the disposal of the petitioners to agitate their grievance if any, present or prospective against any authority, be it Government of UT of J&K or statutory authorities, for which the petitioners are always well within their right to come up with a fresh legal course of action including institution of a writ petition at their discretion.
03. As such the contempt petition is allowed to be withdrawn with liberty to avail appropriate legal remedy.
04. Dismissed as withdrawn with liberty granted.
