05.05.2026

1. Petitioner, through the medium of this petition, alleging that respondent No. 4- Tehsildar Central Shalteng, has rejected the application of the petitioner for issuance of Fard on flimsy grounds, unknown to the law, seeks direction upon respondents to do their official duty by attesting/issuing the revenue documents, if all the legal formalities are completed by the petitioner.

2. Learned counsel for the petitioner submits that petitioners shall be satisfied if the present petition is disposed of at this stage with liberty to the petitioner to apply afresh for the Fard to the Tehsildar concerned and

with a direction to the Tehsildar to decide the matter with regard to issuance of Fard, strictly in accordance with law.

5. In view of the of the innocuous nature of prayer and submissions made by the learned counsel for the petitioner, the present petition is disposed of at this motion stage with liberty to the petitioner to apply afresh for the issuance of the Fard to Tehsildar Central Shalteng and in the event of doing so, respondent- Tehsildar Central Shalteng is directed to consider issuance of the Fard, strictly in accordance with law. It is further clarified that in the event of rejection of his plea for grant of Fard, petitioner shall explore the remedy of challenging the same before the competent revenue authorities.

6. Accordingly, the present petition is disposed of, on the above terms, along with connected application(s).
