ORDER

17.12.2025

1. Petitioner has moved this application for grant of bail in his favour in a case pending before Principles Sessions Court, Srinagar titled “UT of J & K through P/S Soura, Srinagar vs Ishfaq Ahmad Rather” arising out of FIR No. 22/2017 under Sections 302 & 120-B RPC in P/S Soura.

2. The learned senior counsel appearing for the petitioner submits that the trial court has posted the main case for final arguments, however, there is a delay in disposal of the case, and, as such, the petitioner has moved this application for grant of bail. He further submits that he has instructions not to pursue this application in case this court directs the trial court to conclude the hearing of the case at an early date.

3. It appears from the Order dated 16.12.2025 passed by the Trial Court, which is made available, that the court is seized of the matter for final hearing in the case and the case is again listed today for continuation of arguments and it is expected that the trial court is in the process of concluding the case finally, within a short span of time.

4. In this view of the matter, this Bail Application is disposed of as not pressed with the direction to the trial court to dispose of the matter at the earliest possible, failing which bail plea shall be considered.

5. Disposed of.
